Arkema France SA can avoid a class of Texas residents who sought damages over alleged exposure to toxins after Hurricane Harvey struck its facility, a federal judge in the state ruled, but it must face a class that seeks medical monitoring and property cleanup.
Crosby, Tex., residents sued after Arkema’s trailers containing organic peroxide exploded in 2017 and sent ash and smoke into the air. People near the facility experienced rashes, headaches, blisters, and other ailments, according to the complaint filed in the US District Court for the Southern District of Texas.
